Abstract:
هدفت الدراسة لمعرفت اثر جريمة الإرهاب علي ززيادة العمليات الإرهابية واعاقة الجهود المبذولة لمكافحتها بلإضافة الي معرفة دور المؤسسات المالية في كشف خيوط الجريمة ودور السلطات في إنفاذ القانون من خلال الربط بين نشاط الجريمة المنظمة العابرة للحدود الوطنية وجريمة تمويل الإرهاب باعتبارها مكملات للبعض.
تمثلت مشكلة البحث: في ان الإرهاب وتموله اصبح مهدداً امنياً وان تمويله يعد جريمة ذاتية تسبق تنفيذ جريمة الإرهاب, وتستوجب العقاب سواء وقعت الجريمة ام لم تقع لذا لابد من بيان مصادر تمويل الإرهاب وواجهاته وتوضيح اثر الأحتجاج بسرية المستندات و المعلومات المالية في إتساع دائرة العلمية الإرهابية من خلال انفلات مرتكبي جريمة تمويله من الملاحقات القانونية.
اتبعت الدراسة المنهج التاريخي والتحليلي الوصفي, توصلت الي عدة نتائج من إبرازها ان جيمة الإرهاب ظاهرة عالمية تختلف دوافعها واسبابها من مجتمع لاخر. وقد تكون دينية , ام عرفية, ثقافية , اقتصادية وسياسية, ويلجأ القانون الي المطالبة او التنازل عن مواقف اتخذت مسبقاً, وان اللجؤ الي الحلول الامنية المؤقته دون مخاطبة جذور المشكلة بالطرق والوسائل السليمة والاحتكام الي العنف المضاد من اهم الأسباب التي تؤي انتشار هذه الظاهرة.
تمثلة اهم توصيات الدراسة في ضرورة تشديد رقاب الدولة علي الأستثمارات الأجنبية والأنشطة التجارية التي تقوم بها شركات متعددة الجنسيات, وتقديم الحلول الدبلوماسية علي الحلول الأمنية عند التعامل مع قضايا الإرهاب وعدم اللجؤ الي التدخل العسكري إلا بعد فشل كل المحاولات السلمية.
