جريمة إشانة السمعة والقيود التى تفرضها علي حرية الصحافة في القانون الجنائى السودانى

Abstract

هدفت الدراسة إلى التعرف على جريمة اشانة السمعة والآثار المترتبة على النشر الصحفى ، كما هدفت الى التعرف على الطرق القانونية لحماية سمعة الأفراد من التشويه كما هدفت الى تسليط الضوء علي السوابق القانونية في مجال اشانة السمعة وتبصير الصحافيين بالنصوص القانونية للحيلولة دون الوقوع في جريمة اشانة السمعة. استخدم الباحث المنهج الوصفى التحليلى والمقارن ، توصلت الدراسة إلى عدد من النتائج أهمها: أوصت الدراسة : بضرورة كفالة حرية الرأى والتعبير في الدستور السودانى والعمل على نشر الثقافة القانونية في الأوساط الصحافية بالسودان. This study aims at identifying the crime of dishonor as well as recognyzing the serious effects that resulted from publishing on the newspaper. The study not only aims at recognyzing the legal methods that protect the individuals reputation agaist distortion,but aims to spotlight the legal precedents in the field of reputation in addition to journalists enlightenment on legal texts to prevent the crime of reputation. The study uses the descriptive and analytical descriptive method. The study has reached to the following findings: The Sudanese law defines limits to protect privacy and guarantees the right of the media to criticize the public employee for the public interest. The Press Law and Publications law of 2009 do not include clear legal provisions for reputation. The study recommends : The necessity of acceptance legal responsibilities for freedom of opinion and expression in the Sudanese Constitution to spread out the legal culture in the press agencies in Sudan
